Terms and Conditions (AGB) – Pearlix

§1 Scope and Consumer Definition

(1) These Terms and Conditions apply to all contracts concluded between the seller and the customer via the Pearlix online shop.

(2) The offer is directed exclusively at consumers. A consumer is any natural person who enters into a legal transaction for purposes that predominantly cannot be attributed to their commercial or self-employed professional activity (Section 13 German Civil Code – BGB).

(3) Deviating, conflicting, or supplementary terms and conditions of the customer shall not apply unless their validity has been expressly agreed to in text form.

§2 Contractual Partner

§3 Conclusion of Contract and Contract Language

(1) The presentation of products in the online shop does not constitute a legally binding offer, but a non-binding invitation to place an order.

(2) By clicking the button “Buy now”, “Buy”, or “Order with obligation to pay”, the customer submits a binding offer to conclude a purchase contract.

(3) Receipt of the order is confirmed immediately by email. The purchase contract is concluded when we accept the customer’s offer by an explicit order confirmation via email or by dispatching the goods.

(4) The contract text will be sent to the customer by email after conclusion of the contract. The contract language is German.

§4 Prices and Shipping Costs

(1) All prices stated are final prices.
In accordance with Section 19 of the German VAT Act (UStG), no VAT is charged (small business regulation).

(2) Shipping within Germany and the European Union is free of charge.

(3) For deliveries to Switzerland and the United Kingdom, shipping costs of €10 apply.

(4) Further details regarding shipping methods, shipping providers, and delivery times can be found in the separate shipping policy available in the online shop.

§5 Payment Methods

The following payment methods are available in the online shop, subject to availability:
PayPal, Klarna, and Shopify Payments (e.g. credit card).

The respective terms and conditions of the payment service providers apply.

§6 Delivery and Transfer of Risk

(1) Delivery is made to the delivery address provided by the customer.

(2) Information on shipping duration, delivery times, and shipping methods can be found in the separate shipping policy.

(3) If the customer is a consumer, the risk of accidental loss or accidental deterioration of the goods passes to the customer only upon delivery of the goods.

§7 Retention of Title

The goods remain the property of the seller until full payment of the purchase price has been made.

§8 Right of Withdrawal

(1) Consumers are entitled to a statutory right of withdrawal.

(2) Details regarding the right of withdrawal, in particular deadlines, exercise, returns, and refunds, can be found in the separate withdrawal policy available in the online shop.

(3) In the event of withdrawal, the buyer bears the direct costs of returning the goods (Section 357(6) BGB).

§9 Warranty

The statutory warranty rights apply.

§10 Liability

(1) We are liable without limitation in cases of intent and gross negligence, as well as for damages resulting from injury to life, body, or health.

(2) In the event of a slightly negligent breach of essential contractual obligations, liability is limited to the foreseeable damage typical for the contract.

(3) Otherwise, liability is excluded to the extent permitted by law. Claims under the Product Liability Act remain unaffected.

§11 Product Descriptions and Deviations

(1) Product representations in the online shop are for illustrative purposes.

(2) Colors, surfaces, and details of the products may differ slightly from the images due to different screen displays, lighting conditions, and material-related properties.

(3) For jewelry made from natural materials (e.g. pearls), minor variations in shape, structure, or color are typical of the material and do not constitute a defect in the legal sense.

§12 Intellectual Property

All content of the online shop, in particular texts, images, logos, and designs, is protected by copyright.
Use without prior explicit consent is not permitted.

§13 Applicable Law

The law of the Federal Republic of Germany shall apply, excluding the UN Convention on Contracts for the International Sale of Goods (CISG).
Mandatory consumer protection provisions remain unaffected.

§14 Final Provisions

If individual provisions of these Terms and Conditions are or become wholly or partially invalid, the validity of the remaining provisions shall remain unaffected.
